IHC admits plea of Noor’s parents against bail to therapy centre staffers

ISLAMABAD: Taking up the plea of slain Noor Mukadam’s parents for bail cancellation of six accused persons on Friday, the Islamabad High Court (IHC) admitted the petition and issued notices to respondents in the matter.

Earlier, on August 23, Additional Sessions Judge Islamabad Muhammad Ata Rabbani has granted post arrest post-arrest bail facility to six accused persons including Tahir Zahoor, Chief Executive officer of Therapy Centre, and staffers of the Centre including Amjad Mehmood, Dileep Kumar, Wamiq Riaz, Samar Abbas and Abdul Haq.

Assailing the order of the Additional Sessions Judge Islamabad before the IHC, the Shaukat Mukadam, the petitioner contended that the trial court has crossed the tentative assessment of record saying at bail stage law doesn’t allow deep observation of the evidence.

The petitioner contended that the sessions judge did not fulfil the criteria of justice and urged the IHC to cancel the granted bail to the accused persons saying the trial court has ignored the principles, settled by the top court in bail granting.

Appearing before the bench on Friday Barrister Qasim Nawaz Abbasi said all the six accused persons were present on the spot during occurrence of the heinous crime, adding this very fact is established by the record of PIMS hospital in the name of Amjad Mehmood accompanied by Delip Kumar. He said call data records of both of the accused persons verifies they were connected to the CEO of the Center Tahir Zahoor.

The petitioner further submitted that all the accused persons have concealed the rejection of previous post arrest bail of the other accomplices ( parents of the principal accused person Zahir Jaffer) and has violated the dictum laid by the constitutional courts.

During the proceedings, the counsel read out contents of the FIR before the bench saying, “Eleven accused individuals were arrested after supplementary statements, CCTV and CDR evidence was presented,”.

After a brief hearing of the matter, the bench adjourned the case for reply of the accused persons.
