IHC petitioned by investors of ‘One Constitution Avenue’

 

  • Petitioners seek cancellation of all buildings constructed in deviation illegal, unsustainable and incapable of use and occupation

A group of 38 individuals who invested in ‘One Constitution Avenue’ has petitioned Islamabad High Court against the Capital Development Authority, the Capital Administration and the Development Division against the sealing of the building without any prior notice.

‘It was then for the first time the petitioners were made aware of disputes between the leaseholder and developer of the property — BNP Private Limited and CDA,’ reads the petition. The petition also cites a previous judgment of IHC where it was held that no building can be occupied prior to and in the absence of a completion certificate as per the rules of CDA.

The petition also cites that other buildings like Centaurus, Safa Gold Mall, Silver Oaks, Marriott Hotel, Serena Hotel, UBL, Islamabad Stock Exchange, OGDCL were being occupied by residents without obtaining a mandatory completion certificate.

The petition prays that court directs CDA to act in strict accordance with law and enforce the relevant rules and regulations to ensure that no illegal occupation of any building and cancel all permissions granted in this respect.
