Toshakhana disqualification: LHC judge requests for larger bench to hear case

LAHORE: A single member bench of the Lahore High Court on Friday requested the LHC chief justice to form a larger bench for hear a petition challenging disqualification of former prime minister Imran Khan in Toshakhana reference.

LHC Judge Sajid Mahmood Sethi heard the petition filed by Jabir Abbas, a resident of Mianwali through Advocate Azhar Siddique. The counsel argued that the ECP is not a court and therefore cannot disqualify any lawmaker.

After initial hearing, LHC Judge Sajid Mahmood Sethi asked the chief justice to constitute a larger bench for hearing the case.

“The Election Commission of Pakistan can take action on a declaration after 120 days not later than that, the petitioner counsel said. He requested the LHC to nullify the verdict of Imran Khan’s disqualification in Toshakhana reference as the ECP ‘misinterpreted’ the constitution in its verdict.

The plea further stated that if anything illegal has happened, the matter should be forwarded to the relevant authorities as the ECP cannot disqualify anyone.

The ECP declared Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan disqualified in its verdict in the Toshakhana reference, last month.
