Petitioners demand transparent investigation of APS attack

PESHAWAR: On Monday, a two-member bench of Peshawar High Court ordered the issuing of notices to federal and Khyber Pakhtunkhwa governments to submit their replies in response to identical petitions, seeking registration of FIR and Judicial inquiry into the December 16, 2014 tragedy at Army Public School Peshawar.

The bench comprising of Chief Justice Yahya Afridi and Justice Mohammad Azanfar issued the order after listening to the petitioners. Advocate Qazi Mohammad Anwar represented petitioner Ajun Khan whereas petitioner Fazal Khan was represented by Advocate Naveed Akhtar.

Ajun Khan through his petition pleaded before the court to order a judicial probe into the incident which cost 150 lives including 133 teenage students. Qazi Anwar argued that petitioners and other parents lack trust in governmental action and any claims they make regarding the execution of facilitators and others co-accused. However, the court informed that only either the federal or provincial government could order a judicial inquiry into such acts.

Whereas Naveed Akhtar on behalf of Fazal Khan expressed dissatisfaction with federal government and law enforcing agencies over claims regarding investigation and punishment of responsible terrorists, pleading the court to order a record of his statement. He further said that in the light of such a statement FIR will be registered against the responsible persons.

Both lawyers argued that there still exists confusion regarding the culprits involved in the deadly attack at Army Public School Peshawar; therefore, parents and others concerned have the right to know more about its investigation.

The court later adjourned proceeding till July 6th and ordered notices to both federal and KP governments to submit their responses.
