IHC dismisses plea of Grand Hyatt

The High Court has dismissed the petitions of Grand Hyatt and apartment owners filed against CDA’s Board decision dated July 29, 2016.

Builders of Grand Hyatt M/S BNP and apartment owners had challenged the CDA Board decision taken on July 29, 2016 vide which lease of the Hotel Grand Hyatt was cancelled on account of various violations of CDA ordinances and building regulations. CDA was represented through Additional Legal Advisor of the Authority, Kashif Ali Malik and Iftekhar Gilani, advocate whereas the petitioners were represented by Barrister Aitzaz Ahsan, Mrs Aasma Jahangir, Khawaja Haris Ahmed, Babar Sattar and Ali Raza advocates. The writ petition No 3043/2016 was filed in the court of Mr Justice Athar Minalah of the Islamabad High Court.

The case was heard on almost daily basis for around seven months. After hearing point of view of all parties, the court dismissed the petitions filed against CDA Board decision. However, the court has directed the federal government and CDA to take necessary measures for compensation of apartment’s owners.
