ISLAMABAD: The Islamabad High Court (IHC) has ruled that 'exclusive jurisdiction' clauses in employment contracts should not be used to oppress or disadvantage workers.

The decision was issued by IHC Chief Justice Aamer Farooq in a detailed judgment on a petition filed by a former employee of a private company. The petitioner had challenged the company's reliance on an 'exclusive jurisdiction' clause in his employment contract, which required any legal dispute to be resolved in a court outside Islamabad, despite the employee being based in the capital.

Justice Farooq stated that such clauses cannot override statutory rights granted to employees under Pakistani law. He observed that while parties to a contract may agree on a particular jurisdiction for resolving disputes, this agreement cannot be used as a tool to deny workers access to justice or to suppress their legal rights.

The judgment clarified that exclusive jurisdiction clauses must not be enforced in a manner that would create hardship for employees or restrict their ability to seek redress in appropriate forums. The court emphasized that employment contracts are not ordinary commercial agreements, and the law provides special protection to workers to prevent exploitation.

Justice Farooq further noted that the courts have a duty to ensure that such contractual provisions are not used to oppress employees or to circumvent statutory protections. He remarked, "Exclusive jurisdiction clauses cannot be used to oppress workers."

The IHC's decision is expected to have significant implications for employment contracts across Pakistan, particularly those that seek to limit the legal options available to workers in case of disputes.
