Court dismisses plea for FIR against driver in DHA delivery rider’s death

KARACHI: A sessions court in Karachi has rejected an application seeking the registration of a First Information Report (FIR) against a car driver whose alleged reckless driving resulted in the death of a young delivery rider in the Defence Housing Authority (DHA) last month.

The court’s decision came after the father of the deceased, Farhan Ali, informed the court that he had pardoned the driver, Hasan Banghwar. The incident occurred on February 22, when 26-year-old Farhan Ali was sitting on his motorcycle in front of a house near the main Saba Avenue signal. Viral videos on social media captured the moment a speeding car overturned and crashed into him. Farhan Ali later succumbed to his injuries during treatment at a hospital.

Following the incident, police released Hasan Banghwar on personal surety, with the consent of Farhan Ali’s parents, and without formally charging him. Subsequently, Irfan Ali filed an application requesting the court to direct the registration of an FIR against the driver and others involved.

After hearing the arguments, the additional district and sessions judge (South) dismissed the application. The court noted that the father of the deceased had pardoned the driver, which influenced the decision to reject the plea for an FIR.

The case has drawn attention on social media, with many sharing footage of the accident and discussing the legal proceedings that followed. However, with the court’s dismissal of the application and the family’s decision to pardon the driver, the matter has not proceeded to formal criminal charges.
