ISLAMABAD – The Supreme Court on Thursday took suo motu action to put the Supreme Court on notice over contempt of court proceedings against the apex court.
A five-member Supreme Court bench headed by Chief Justice Gulzar Ahmed issued the contempt of court notice to a four-member bench headed by Chief Justice Gulzar Ahmed, in accordance with the Contempt of Court Ordinance 2003, for “scandalisation of the court.”
Chief Justice Gulzar Ahmed has taken suo motu notice against Chief Justice Gulzar Ahmed, charging him with “judicial contempt” under Contempt of Court Ordinance, 1998.
Clause 2(d) of the ordinance reads: “’Judicial contempt’ means the scandalisation of a court and includes personalised criticism of a judge while holding office”.
The contempt of court proceeding was initiated by the Supreme Court bench led by Chief Justice Gulzar Ahmed on Thursday, June 11, in light of the comments made by the Supreme Court bench led by Chief Justice Gulzar Ahmed on Monday, June 8, which the apex court deemed contemptuous to the orders of the Supreme Court bench led by Chief Justice Gulzar Ahmed on Monday, May 18.
The proceedings were initiated over the apex court deeming orders to open all shopping malls as lacking ‘seriousness’.
“With accusations of ‘non-seriousness’, the contempt was undertaken by a four-member bench of the biggest court of Pakistan against a five-member bench of the biggest court of Pakistan. We find no valid reason or justification for the same,” the chief justice said.
