SC hears contempt cases against PCO judges today

ISLAMABAD: The newly constituted four-member bench of the Supreme Court will hear toady (Monday) contempt charges against the superior courts’ former judges who took oath under the PCO in November 2007. The bench comprises Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawwad S Khawaja, Justice Khilji Arif Hussain and Justice Tariq Parvez. Besides counsels for the PCO judges, Attorney General Moulvi Anwarul Haq will also appear before the bench on notice.
Earlier on December 6, a five-member bench had declared as invalid the objections raised by the counsel for two PCO judges over the formation of the bench. The head of the bench, Justice Muhammad Sair Ali, however, left the bench voluntarily before adjourning the case till Dec 13. Dr Abdul Basit, counsel for Justice Shabbar Raza Rizvi and Justice Hasnat Ahmed Khan, had objected to the presence of three judges in the bench, including Justice Muhammad Sair Ali, Justice Mahmood Akhtar Shahid Siddiqui and Justice Tariq Parvez.
Dr Basit has also already filed an intra-court appeal against the dismissal of the petition with a request that the proceedings be halted till the allegation of the bias raised against the members of the bench is decided. On July 8, he also objected to the presence of Justice Nasirul Mulk and Justice Raja Fayyaz Ahmed who chose not to sit in the bench.
