CJP lays down the law for son
ISLAMABAD - The reputation of the institution, not son, will be protected as law applies to all equally irrespective of the status and relationship, Chief Justice Iftikhar Muhammad Chaudhry said on Wednesday while conducting suo motu hearing of an alleged graft case involving his son Dr Arsalan Iftikhar Chaudhry.
The case surfaces at a time when the Supreme Court is seized with a number of corruption cases against the government.
While the case, which might turn out to be the mother of all conspiracies, has shaken the top judge, the CJP categorically made it clear that if his son was found involved in the case, the law would take its course.
Media reports said Dr Arsalan had received Rs 300 million to Rs 400 million from real estate tycoon and Bahria Town Chairman Malik Riaz on various occasions. However, Dr Arsalan dismissed these reports.
Bahria Town Vice Chief Executive Commodore Ilyas said that Arsalan had not been given any money from the five projects under him. A three-member SC bench headed by Chief Justice Iftikhar Muhammad Chaudhry, heard the case on Wednesday.
Addressing the CJP, Attorney General Irfan Qadir said that he could not be part of the bench as the case involved his son. But the chief justice took the position that the court was aware of the code of conduct and it was a matter of the institution’s respect.
“You are getting emotional on the matter that is why I am of the view that the chief justice should not sit on the bench,” the attorney general said.
Justice Jawad S Khawaja observed that they were not getting emotional.
While hearing the case, the court asked the chief executive of Geo TV to provide whatever material anchors Hamid Mir, Najam Sethi and Kamran Khan had regarding this case. Hamid Mir, however, appeared before the court and said that Malik Riaz had shown him some documents and also claimed that he had a video footage as well. He told the court that neither he nor Shaheen Sehbai had any content regarding the accusations.
The court then summoned anchor Kamran Khan and the channel’s chief executive on Thursday (today).
The bench also directed the Islamabad inspector general of police to take the record of Bahria Town in his possession and produce relevant evidence for the case in the court.
The Supreme Court had on Tuesday summoned Dr Arsalan, Attorney General for Pakistan Irfan Qadir and Bahria Town Chairman Malik Riaz. While Dr Arsalan appeared before the court, Malik Riaz remained absent.
However, he was asked to be present in court along with complete record of Bahria Town.
Dr Arsalan said in the court that the allegations that he had received Rs 300 million to Rs 400 million and lavish foreign tours from Bahria Town were baseless.
A personal staff officer of Bahria Town informed the court that Malik Riaz was in the UK for medical treatment.
When the chief justice inquired whether Malik Riaz had received the court’s summons, the principal staff officer said he had not been able to get in touch with Malik Riaz.
When the court asked who took care of the business affairs in Malik Riaz’s absence, the officer took eight names including that of Malik Riaz’s son Ahmed Ali Riaz. “Commander Illyas, Wing Commander Ayaz, Gen Ehtisham Zameer, Shaukat Sultan, Maryam Rehman, Brig Ahad and Ahmed Ali Riaz take care of the business affairs in his absence,” he said.
Speaking to reporters outside the courtroom, Dr Arsalan’s counsel Sardar Ishaq said the court had taken no decision yet but had adjourned the hearing.
He said the court had stated that the data related to the case would be provided to the counsel in the next hearing. The Supreme Court also ordered that Malik Riaz should be present in the court.
“I think it is a conspiracy to malign the Supreme Court,” Dr Arsalan’s lawyer said. “We will expose the people behind this conspiracy and proceed against them,” he added.
Earlier, TV channels reported that Justice Chaudhry had expelled his son from his house and told him he is ‘’no relation’’ of his while he hears a corruption case that involves him.

The scheme to entrap CJ’s son is a cynical attempt to convince Pakistanis of their own baseness. Once we are convinced that there is nothing noble left in us, we are finished as a formidable force. Then it becomes easy for our enemies to crush us. There is a grand conspiracy on to destroy Pakistan from within because they cannot do it from without!
Pakistan isindeed a sick and evil soceity.
These days all judges are acting like a political party, and it cannot be expected that, given the Govt-Judiciary tussle, they will be able to dispense justice. Therefore, a neutral agency, such as ISI or Military Intelligence Services should be directed to start investigations, just as people demand to call in army to hold impartial elections.
It is not democratic govt, but some defence agencies seem to be behind this plot, becoz CJ was taking action in case of missed persons and Baluchistan. Surely, govt will take benefit from this, but some intelligence agencies which r out of civilian control and serve under someone else seem to be behind this plot, coz CJ was hearing missed persons case who r in custody of intelligence agencies.
It is unprecedented in our history of justice that such a case is brought to the accused’s father as cj . Hope for the fair decision. I could smell some thing fishy.
And the fishy thing you smell is … that he will let his son off the hook? Doesn’t look like that to me – not if you have followed this man’s actions the last few years. I think he will surprise you among many other skeptics.
Hats Off to CJ, last night in 10pm’s talk shows this story was discussed in different news channels, CJ took notice at 1.45am same night. We will witness the Justice now that will remember us the Justice of Khulafa’s period !!!!!
Why not CJ is leaving the bencn and trusting his colleague judges to decide? Why is he using Quran? One's intentions are clear by his practical steps. And this CJ is not leaving the bench? Surely something stinky.Honoureable CJ has one standard for his son and other for rest of the people. It is against principles of natural justice.
These corrupt elements who with criminal intentions wanted to influence the course of justice by blackmailing the Chief Justice of Pakistan must be exposed. A high powered judicial commission must thoroughly investigate this matter and people must see the justice being done. This is one such case the outcome of which will determine the future of this country.
Electronic media is the main tool being used tomalign SC. Why Hamid Mir and Kamran Khan telecasted the programmes. As per jounalism norms they should have get clarification from CJP and Dr. Arsalan. For God's sake independence does not mean that media should malign SC with out proof and on hearsay basis. Dr Arsalan might had committed mistakes for which CJP has already ejected him from his home and restrained him to contact which is a historical decision. Every body is afraid of media because yeh kissi ki bhi kissi waqt pagri uchal saktay hai..

The simple point is if Arsalan took the illegal money, he should be sentenced accordingly. Forget everything else.

Do punish culprit. CJP assured to punish Arsalan if proved guilty. But there must be check on media particularly who are working on particular agenda.

When this same electronic media telecast the programmes about alleged corruption of government,s ministers and high ups do they ask for permission from those politicians.Chief justice ejected his son from home saying that Son don,t worry since i will be heading the bench you will be declared innocent in matter of days. because this is not a memo gate scandal for which I initially ordered to complete investigation within 2 weeks and now it seems ages have passed and still no out come.@ Mr. Khalid if you remember, the very famous quote for our nation "THIS CASE WILL DETERMINE THE OUT COME OF OUR FUTURE" was also said for Memo gate scandal,contempt case of PM,NRO Case,case of 3rd November emergency of Musharraf,Case of 2 offices holded by Musharraf,Case of missing persons and the list goes on. Do not you think it is time that we decide and determine exactly which case will determine the future of our country.

Hamid Mir's role in this case is also dubious. He had no right to allage CJP without ant proof in hand. Today he again tried to mislead SC by exonerating PPP Govt and tried to implicate Agencies against whome he had launched full throttle campaign tomalign them. He committed contempt of court. He is not sacred cow.

Surely punish if he is involved. But this guy Hamid Mir is on payrol of some one else not just the jang group! Crook managed to deceive people for so long and working against Pakistani state interests.
do punish the culprit, he may be CJP son or any body else, so there is no second opinion but about Hamid Mir, I agree 100%.
Malik Reaz is a shady character but why would he doleout such money to this man unless he had some axe to grind!!!
Malik Riaz is also deep connections with Asif Zardari……. As concern the son of CJ,he ( Arsalan Iftikhar )has some fishy record………..lets see what a father will do with his son,if allegations are being proved ?
I do not understand what is wrong with our people. What makes anyone think that this CJ is any different from any one of us? Even when he stood up to Pervez Musharraf, he had appointed his son in good positions and that was the reason for Pervez Musharraf to ask him to resign after having ben a PCO Chief Justice for 7 years. People forget too easily, he supported Pervez Musharraf and legalized him. The judicial movement was paid movement otherwise these DACOITS called judges and lawyers will not do anything for anyone, deal with them and you will know how base and shallow they are. In this case as per GEO, the friendship valued at 35 to 40 Crore between Malik Riaz and Arsalan Iftikhar has been going on for 2 to 3 years, my question is where was the CJ, all this time, was he sleeping? Ye log kub tak hamain bewakoof bantay rahain gaye aur hum bantay rahain gaye. Suo Moto notice is fine but hearing the case himself is not, this is against all legal norms.
This is a conspiracy to maligh the SC by the nexus of the corrupt who want to scandalize the CJP so that he can no longer stop them. If they succed Pakistan will become another Somalia, If they fail, we have hope for a change in reality, not just rhetoric.

I think all the powerful & influential corrupt mafias of the society have joined hands to defame the Chief Justice of Pakistan. I am sure Allah will help the Chief Justice of Pakistan again and the criminals will again be exposed, humiliated and punished accordingly. God willing, Justice will be prevailed and The Chief Justice of Pakistan will continue to twist the arms of corrupt mafias and made them cough the looted wealth of country.

There is no government is Pakistan. It is a failed state just about to collapse.

CJ's insistence to sit on the bench with his own hand picked judges makes this story fishy. courts are not investigation agencies so it would be better if the case be investigated by FIA, NAB or some other police.
The end result of this whole drama: Chief Justice will find somehow government,s and ISI hands behind all this. The Son of chief will be acquitted with honor and “Chamchas” of CJ will put drums around their necks to praise CJ day and nights on talk shows. Prepare your minds also to listen the similarities among Great caliphs of Muslims and CJ.
I often wonder if there are any bigger hypocrites than us living on this earth. If PM son is named in Drug Scandal we do not even bother to wait for the trial and its conclusion and immediately declare not only him but whole of his family the biggest culprits on this planet and now when THE ANGEL,S Son is in the line of fire, without wasting a second our noses became so strong to smell something fishy and our noses has also find out that fishy stink is coming from President,s house and GHQ.Believe me even after 500 years we as the nation will be wandering around to find water,protesting load shedding,inflation unemployment etc. because we have decided not to grow mentally. The person we like, is some thing like a “WALI” or even a prophet who can do nothing wrong and the person we do not like is like a “DEVIL” from whom no good thing can come.
